Where an MVV is required, the application goes through the entry and residence procedure (Toegang en Verblijf, TEV). You must not be a danger to public order or national security. The IND checks this through an antecedents declaration, and even a modest conviction can be an obstacle. The assessment weighs the sentence against the length of your lawful residence.

Foreign documents such as birth and marriage certificates must generally be legalised or carry an apostille, and be translated by a sworn translator. Legalisation in the country of origin can take months and is the most common cause of delay.

In practice, a recognised sponsor’s application for a highly skilled migrant is usually decided well within the 90 days. Categories that need a labour market test by the UWV or an assessment by the RVO take longer.

If the IND does not decide in time, you can give notice of default (ingebrekestelling) under the General Administrative Law Act (Algemene wet bestuursrecht, Awb). If the IND still has not decided two weeks after that notice, you can appeal to the administrative court. Since 15 April 2025 the IND no longer owes an administrative penalty (dwangsom) for a late decision on a residence application, but the court can still order the IND to decide within a set period, on pain of a penalty. The procedure forces a decision, not a positive one.

A breach of these duties can lead to an administrative fine and to suspension or withdrawal of recognition. If the migrant no longer meets the conditions, the residence permit itself can be withdrawn.

An IND decision is an administrative decision under the Awb, so the ordinary administrative remedies apply. In the objection the IND reconsiders the whole case, including new facts and documents. If the IND rejects the objection, you can appeal to the district court within four weeks. A further appeal lies with the Administrative Jurisdiction Division of the Council of State.

First, an objection does not always allow you to stay in the Netherlands while it is pending. The IND decision states whether you may await the outcome here. A late objection is declared inadmissible unless the delay is excusable, and disagreeing with the decision is not an excuse.
